Alina Habba has stepped down as the chief federal prosecutor in the state. This follows a court battle that questioned her eligibility to occupy the role.

Acceptance of Resignation

US Attorney General, Pam Bondi, accepted her stepping down on the start of the week. Bondi stated that the appeals court finding made it impossible for her to effectively run her office.

"Do not interpret compliance for surrender," Habba stated. "My fight will now stretch across the nation."

Judicial Challenge

Her resignation comes a week after a federal appellate panel ruled that she had been unlawfully serving as the top prosecutor. This judgment is likely to affect many legal proceedings in New Jersey.

The judicial panel declared that a interim role that bypassed Senate approval ran afoul of the federal law governing appointments.

Ongoing Legal Battle

Bondi said that she will stay on at the justice department as a high-level advisor. She will pursue additional appeals of the ruling, with hopes of a different outcome.

Writing online, she contended that judges "should not be able to override the President's choice of prosecutors tasked with carrying out the executive branch's core responsibility of criminal prosecution."

Record and Legacy

The attorney general praised her tenure and pointed out that while she was in charge, the city of Newark saw a significant drop in offenses. She also stated that the city of Camden had its first summer in half a century with no murders.

Background and Previous Role

The 41-year-old attorney, was initially recruited to Trump's personal legal team in 2021. Subsequently, she represented the former president in his hush-money trial in the previous year, when he was conviction on 34 counts of financial record manipulation.

Before Habba took on the top New Jersey post, the former president had announced he was selecting her as his White House advisor if re-elected, describing her as a steadfast ally and a relentless legal advocate.
